Section 1: Teacher’s role:
1.1. Each new student to E&E is entitled to a free trial lesson with a
teacher (hereafter referred to as ‘you’) before deciding whether to join
us. EnglishEverywhere.com (hereafter referred to as ‘we’, ‘us’or ‘E&E’) may therefore
require you to conduct a free 15-minute trial class (thus no wage for this
class will be remitted to you) on occasion.
1.2. Before the trial class (and any class with a new student) you will need
to access information on the student, their level and what messenger system
they are using (e.g. MSN/Windows Live or Skype) on the Bulletin Board.
1.3. With any new student we ask you to create a rough curriculum for the student
to follow based on their interests and their purpose of learning English.
For example, if they are learning English mainly as a travel tool, then
we would like you to concentrate your topics on situations the student
may find him/herself in when traveling. Likewise if they want to study
Business English, we expect you to tailor the classes to the student’s
goal. We ask you to prepare lesson material (Word file or URL etc) and send it
to the student via the E&E email system.
1.4. Within each class we want you to follow our ideal lesson content as outlined
on the 'How it Works' and Overview pages .
1.5. After class we require you to fill in the online “class report” sheet
to inform us of how the class proceeded and what material was covered within
the class. This allows us to keep an up-to-date file on the student’s
progress. All the information is uploaded onto our Bulletin Board for teachers
to have access to, and a copy is sent automatically to the student for
their records. We require you to do this immediately after the class finishes.
Please note that this also provides a record that the class has been completed
and thus is also used when counting up the amount of lessons you have taught.
Therefore if we do not receive it we cannot count that that class has been
done. If we do not receive this report within 24hours we will charge you 200YEN
late fee.
1.6. Time difference calculations are your responsibility. Requested class
times are shown in Japan Time and your local time on the reservation request,
however, please double check these times especially when Daylight Savings
comes into affect. A good site for checking time differences is: http://www.timezoneconverter.com/cgi-bin/tzc.tzc however, when using this site please make sure you click off the "Use
Current Date/Time" box as if you don't you will get an inaccurate
time conversion.
1.7. If the student is not happy with classes and if they want to change teachers
they have every right to find a new teacher to work with.
Section 2: Conditions and Conduct:
2.1. We expect all information provided by you to us is correct to the best
of your knowledge.
2.2. We require you to check your e-mail at least once a day. If you have a
reservation request please respond on the day you receive it. Please note that you are required to reply to e-mails from EnglishEverywhere
within 36hours. If we do not receive a reply we reserve the right to block
your availability schedule until we hear from you.
2.3. We require you to reply to our e-mails within 36hours. If we consider that
you persistently don't reply, we reserve the right to terminate your contract
with us.
2.4.If we have sent an e-mails but do not recieve any reply from you for 60days, we reserve the right to delete your profile and not pay any outstanding
lessons.
2.5. Giving your personal e-mail information or telephone number to a student is prohibited. This is to protect both student's and teacher's privacy.
2.6. When e-mailing students you must always use EnglishEverywhere's email system.
It is prohibited for teachers to contact students from their private e-mail
addresses (or to a student's private e-mail).
2.7. We require you to be on-time for classes.
2.8. We require you to be on-time for any meetings with us.
2.9. We expect the utmost professionalism from you at all times.
2.10. We reserve the right to monitor your teaching and your conduct. If we
discover you to be unprofessional (being late for class, teaching whilst
intoxicated, engaging in lewd behaviour etc) or not suited to online teaching
(for example, not communicative, rude, unfriendly, aggressive behaviour
etc) we reserve the right to terminate your contract with us without notice
from that point onwards and we also reserve the right not to remit your
pay for that class.
2.11. We expect you to look well-groomed when you are teaching and to be dressed appropriately. If there is any untoward nakedness or unprofessional conduct we reserve the right to terminate your contract with us without notice from that point onwards and we also reserve the right not to remit your pay for that class.
2.12. It is your responsibilty, and required by E&E, to keep your availability
schedule up-to-date. If your schedule indicates that you are available
then students expect that you will accept their lesson request. If you
regularly reject lesson requests we reserve the right to block your schedule
until you update it. If this continues to be a problem then we reserve
the right to terminate your contract with us.
2.13. If you are going out-of-town, or on vacation for a few days, please make
sure that you e-mail us as soon as you can prior to leaving to let us know. Please make sure you update your schedule on
the Reservation System so that students do not attempt to schedule lessons
with you in that time.
2.14. Our policy if you cancel a lesson is as follows:

** In the case of holidays you need to ensure that you confirm the class at
least 36hours before the actual lesson is due to happen. Please therefore allow at least an
extra day (depending on your time zone) as unavailable on your
schedule to give you enough time to confirm the classes when you get back.
If you don't confirm at least 36hours before the actual lesson time we
will charge you -300yen, as in the 'no reply' regulation above.
2.15. Our policy regarding student cancellations:

2.17. We require class reports to be sent on the day the lesson was done. Regulations

*The time will be calculated and recorded when the class report has been
sent to E&E. The duration of the time E&E is checking is not included
in the above time-limits. *E&E students
have a tendency to request lessons after they have received the class report so
that it will be better to send it sooner as students will be more likely to
reserve your classes again.
2.18. You are eligible for a bonus if you do the following:

month. *Please note this will be applied to a minimum of 30 lessons which
were made through the reservation system in a month. |

2.19. There is to be no eliciting of students from us. If we discover at any
point that you are trying to elicit students from us we reserve the right
to terminate your contract without notice from that point onwards. By eliciting
we mean:
a) EnglishEverywhere teachers are not to teach classes (or suggest
to teach classes) to EnglishEverywhere students privately outside
of EnglishEverywhere.
b) EnglishEverywhere teachers are not to accept private lessons of any kind, even if it is the student that initiates the discussion, and even if the student states that they will continue studying at EnglishEverywhere.
c) EnglishEverywhere teachers are not to offer students cheaper rates (or the same rate) privately, than the student is paying at EnglishEverywhere.
d) EnglishEverywhere teachers are not to recommend (or facilitate in any
way*) students studying with teachers who don't work for EnglishEverywhere.
* For example, by passing on your (or another teachers) website, blogsite, e-mail address, any kind of messenger address (eg. MSN, Yahoo, Skype etc) or any contact details to a student, or vice versa, with the intention of recommending the student to study somewhere other than EnglishEverywhere.
If we find that you have engaged in any of these activities we reserve
the right to terminate your contract and pursue legal action against you.
2.20. You are not to share/leak the details of how E&E works, or the systems
we use, with any other company, or indivdual starting a company.
2.21. If we discover that you are using our business concept and system for
your own private enterprise we reserve the right to terminate your contract
with us without further notice and potentially pursue legal action against
you.
2.22. If you decide to leave EnglishEverywhere, or if EnglishEverywhere terminates your contract, you are not to contact any student's privately via e-mail, blogs or telephone (nor give your information for the student to contact you) after finishing working with us.
2.23. If you decide to leave EnglishEverywhere, or if EnglishEverywhere terminates
your contract, you are not to give students your e-mail, blog or telephone
for them to contact you.
2.24. If you wish to terminate your contract with us you must give us a minimum
of two weeks notice and finish all your classes in good faith until the
end of your contract. If you decide to leave E&E, but you don't give the required notice
period and you have confirmed lessons yet to be done (and if you don't
honour them as required by our regulations), we will calculate the number
of outstanding lessons muliplied by your wage and we will subtract this
amount from your final payment. E&E does, however, always consider
each teacher's situation, so this is open to our discretion.
2.25. If your student(s) or E&E, requests you to provide a summary of what
you have taught, or an evaluation of their progress, you must comply, and
send it to us before the end of your notice period.
2.26. In the event that you decide you don't want to work with us anymore and have no scheduled classes to finish you must still give us two weeks notice.
Section 3: Remittance of wage:
3.1. E&E will pay you 800YEN per 30-minute class for the first 10 classes
(one class is 30 minutes, therefore if you teach a 60 minute class you
will be paid for 2 lessons). After 10 classes we will raise your wage to
900YEN per 30 minute class.
3.2. Please send us an e-mail when you have completed all your class reports
up to, and including, the 25th of the month. We will then begin to process
your payment.
3.3. We will start checking the payments on the 25th of the month, and will send your
payment before the 10th of the following month.
3.4. If you do not teach 10 classes with us within a month (the 25th to the following 25th) we will carry over your class payment to the following month, or the time when you have completed 10 classes with us.
3.5. Your pay will be remitted to you via ‘PayPal.com’ thus we require you to set up a Premier account with them, so that you can receive the money from us (currently Japanese
accounts can only use credit card accounts to remit money, thus a premier
account is necessary to receive this money). Please make sure you inform
us what e-mail address you used to set up your account
3.6. Any PayPal.com charges to be paid in the receiving country are to be paid by you and not by EnglishEverywhere.com.
3.7. All payments will be rendered in Japanese yen to your PayPal.com account.
3.8. Any fluctuations in exchange rate will not be born by EnglishEverywhere.com
but will be considered a known fact of overseas money transfers.
Section 4: Jump-In Lessons:
4.1. Jump-in lessons can only be done by teachers who are also available for
reserved lesson.
4.2. If you decide to join our jump-in lesson system please ensure that you
are available for a full 30minutes whent you sign-in.
4.2. The students lesson address is registered on the teacher jump-in lesson
accounts. Please DO NOT message the students if you see them online. The
students will message you if they want a lesson. If you message them the
students will likely get upset and if that happens we reserve the right
to take you off of Jump-In lessons.
4.3. Please ensure that you fill in the class report sheet after the class.
If you do not do this we won't have a record of your lesson and as we don't
require the students to tell us about their jump-in lesson, a failure to
submit the class report could result in non-payment for that class.
4.4. Payment per every 30minute Jump-In lesson is 800YEN.
Section 5: Miscellaneous:
5.1 Please note: If at any point you have problems with your computer (i.e.
your computer crashes) or you lose data whilst you are working for EnglishEverywhere,
this is your responsibility, and not EnglishEverywhere's. This has never
happened before and do not foresee that it will, but as a regular practice
we recommend that you create back-ups of your computer. If you need any
advice concerning any computer problems feel free to contact us, and we
will help you if we can.
5.2. If you download any new software onto your computer, (after we have done the initial connection check before the interview), for example, Windows service pack 2, it is your responsibility to contact
us for a connection check again to make sure that your messenger function
is still working reliably. If you do not, and you cannot connect with a
student, we will not be able to pay you anything for that class.
Please make sure you have read and understood the above terms and conditions
BEFORE applying to work with us. On applying to EnglishEverywhere.com these
Terms and Conditions will thus be in effect and is a binding contract between
‘you’, the teacher, and ‘us’, EnglishEverywhere.com. Thank you for
